2. The petitioners seek bail in connection with Bind P.S. Case No. 50 of 2024 registered for the offences under Sections 147, 149, 341, 323, 342, 448, 325, 307, 379, 504, 506, 302 of the Indian Penal Code.

3. As per the prosecution case, the petitioners are said to have brutally assaulted and killed the deceased.

4. The petitioner no. 1 and 2 are in custody since 25.4.2024 and the petitioner no. 3 is in custody since 5.4.2024.

5. Learned counsel for the informant has opposed the application of the petitioner for grant of bail and has submitted that out of five charge-sheeted witnesses, one witness has been examined and the trial has started.

6. I have considered the submission of the parties.

7. The petitioner no. 1 is said to be aged about 75

Patna High Court CR. MISC. No.67231 of 2024(2) dt.25-09-2024 2/2 years old and therefore this application is allowed with regard to him.

8. Let the petitioner no. 1 (Karu Ram), be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the of the learned Judicial Magistrate-III Class, Nalanda / concerned Court below in connection with Bind P.S. Case No. 50 of 2024.

9. As a condition of this order, the petitioner no. 1, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner no. 1.

10. So far as petitioner no. 2 and 3 are concerned, there are serious allegations levelled against them and considering the same, the application for grant of bail on their behalf is hereby dismissed.
