The petitioner is apprehending his arrest in a case registered under Sections 363, 365 and 120(B) of the Indian Penal Code.
Allegation is that the accused persons kidnapped the daughter of the informant and concealed her somewhere. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Earlier also a case was filed for offence under Section 498A I.P.C. against the petitioner by the father of the victim. The victim happens to be his wife. The present
Patna High Court Cr.Misc. No.584 of 2017 (2) dt.11-01-2017 2/2 prosecution has been filed against the petitioner only with an intention to harass him.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Kursakanta (Kuari) P.S. case No.164 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
