JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-02-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in connection with Jamo Bazar P.S. Case No. 06 of 2022 registered for the offence punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.
As per allegation in the FIR, when uncle of the informant was sitting on cot at his door, two miscreants came there on motorcycle and opened fire on his chest, waist and thigh. He died on the way to hospital.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. There is no eye witness of the alleged occurrence. His name came in confessional statement of co-
Patna High Court CR. MISC. No.59657 of 2022(3) dt.24-02-2023 2/2 accused Santosh Singh before the police, which has got no evidentiary value in the eye of law. Petitioner is languishing in judicial custody since 09.06.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMX, Siwan in connection with Jamo Bazar P.S. Case No. 06 of 2022.
