In the instant case show cause has been filed, Annexure-A whereof is the reasoned order passed by the Managing Director, Bihar State Food & Civil Supplies Corporation. Learned counsel appearing for the Corporation submits that the Corporation has not paid arrears to any of the employee and as such the petitioner is not entitled to the benefit of 6th Pay Revision prior to 01.01.2012.
This fact has been disputed by Mr. Ajay Bihari Sinha,
Patna High Court MJC No.2044 of 2015(6) dt.22-01-2019 2/2 learned counsel representing the petitioner.
Considering the aforesaid, this application is disposed of with liberty to the petitioner that in the event any of the employee has been paid arrears contrary to what has been claimed by the counsel for the Corporation the benefit of arrears of 6th Pay Revision, and payment of Group Insurance and leave encashment before 01.01.2012, the petitioner may agitate the matter before appropriate forum alleging the issue of discrimination.
In view of the above, the application stands disposed of accordingly.
