2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 20 and 21 of the NDPS Act.

3. Petitioner is alleged to be indulged in illegal sell and purchase of narcotic (incriminating) substances.

4. It is submitted that petitioner has been made accused in this case only on the basis of confessional statement of co-accused Tunna Mishra. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the alleged occurrence .

5. Learned counsel for the State opposes the bail

Patna High Court CR. MISC. No.62992 of 2023(2) dt.17-10-2023 2/2 petition of the petitioner and submits that this petitioner was found indulged in the illegal selling of narotic drug and his name has transpired on the basis of confessional statement of co-accused Tunnu Mishra who was apprehended on the spot.

6. Considering the nature of accusation and gravity of offence, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
