The petitioner is apprehending his arrest in connection with Hasanpur P.S.Case No.157 of 2019 registered for offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner as per FIR is that the police intercepted a Pick-up Van but the petitioner and other accused persons succeeded in fleeing away and the person apprehended disclosed the name of the petitioner and there is seizure of huge quantity of liquor from the pick up van . It further appears that the petitioner is accused in one more case. Heard learned A.P.P. also.

Having heard both sides and in view of allegation and antecedent of the petitioner, I am not inclined to grant privilege

No.57726 of 2019(2) dt.13-09-2019 2/2 of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid direction, this application is dismissed.
