JUSTICE BIBEK CHAUDHURI ORAL ORDER 25-09-2024 The petitioner has approached this Court with a limited prayer to dispose of the Statutory Appeal filed by him against the order of dismissal, passed in disciplinary proceeding vide Memo No. 11056, dated 21st December, 2023 by the I.G.,

2. At this stage, the petitioner prays for a direction upon the Appellate Authority, The Additional Chief Secretary, Home Department (Jail), Patel Bhawan, Patna, respondent no. 6, to dispose of the Statutory Appeal filed by the petitioner in a time bond manner.

3. I have heard the learned counsels for the petitioner and the State of Bihar.

4. The Statutory Appeal is expected to be disposed of expeditiously. The said Appeal is pending for last 7 to 8 months. The fate of the petitioner relating to his service depends upon the decision to be taken in the Appeal, so the petitioner is interested to get the matter disposed of at the earliest. I find justification in the apprehension and agony of the petitioner.

5. Therefore, the Additional Chief Secretary, Home Department(Jail), Patel Bhawan, Patna, respondent no. 6, is directed to dispose of the Statutory Appeal filed by the petitioner within three months from the date of communication of this order.

6. The petitioner is at liberty to communicate the server copy of this order to the concerned authority.

7. With the above order, the instant writ petition is disposed of.
