Petitioners being In-charge, Headmaster and Secretary of Upgraded Middle School, Bhorha, Raniganj, Araria are apprehending their arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.
It is alleged that these petitioners being Incharge, Headmaster in league with Secretary of the school withdrew Rs. 9,28,500/- for constructing three rooms of the school but the construction was not completed. It is submitted by learned counsel for the petitioners that against the withdrawal of Rs. 9,28,500/-, a sum of Rs. 9,69,969/- has already been deposited in the account of the school.
Patna High Court Cr.Misc. No.46725 of 2014 (4) dt.23-04-2015 2/2 Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Raniganj P.S. Case No. 192 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
