The petitioner seeks bail in connection with Kanti P.S. Case No. 538 of 2019 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 27.09.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the allegation is of recovery of 29.700 litres of liquor from a mango orchard.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and was identified by the Choukidaar with whom he is on an inimical term.

Patna High Court CR. MISC. No.71947 of 2021(2) dt.28-02-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 27.09.2021, charge-sheet has been submitted in the case, was not arrested from the spot and his name was disclosed by the Chowkidaar, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Kanti P.S. Case No. 538 of 2019.
