Petitioner apprehends arrest in a case registered under Sections 363, 366A/34 of Indian Penal Code.

Allegation in the first information report, lodged on 06.08.2018, is that the petitioner, along with another, has enticed away daughter and sister of the informant on 29.07.2018. It is submitted by the petitioner's counsel that the petitioner has been implicated on extraneous consideration. As he was apprehending such implication earlier, he had lodged an informatory petition on 30.08.2018 against the informant. It is stated by the petitioner in the petition that having no criminal antecedent, his implication is on extraneous consideration.

Considering the rival submissions, this Court is inclined to allow prayer for anticipatory bail of the petitioner. Let the petitioner above named, in the event of his arrest or surrender within four weeks from today, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01st Class, Sitamarhi in Riga Police Station Case No 236 of 2018 subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code and also the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
