Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. In this case, the petitioner is seeking regular bail in connection with Bhagwanpur P.S. Case No. 145 of 2021 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. The name of the petitioner figured in the confessional statement of co-accused on whose instance, the alleged liquor was recovered. The petitioner

Considering the above-mentioned facts and circumstances, the petitioner above-named is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Begusarai in connection with Bhagwanpur P.S. Case No. 145 of 2021.

The learned court below itself shall take every endeavour to frame the charge as early as possible. With these observations/directions, this regular bail petition is disposed of.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
