JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379/34 and added section 411 of the Indian Penal Code.
Petitioner is not named in the first information report and it is submitted that petitioner was arrested in connection with a case registered for the offence of Arms Act and police got recorded the confessional statement of petitioner in the aforesaid case and subsequently, remanded the petitioner in the present case. It is further submitted that police claimed that on the basis of confessional statement of petitioner the stolen motorcycle of the present case was recovered from possession of other accused.
Patna High Court Cr.Misc. No.78806 of 2018(2) dt.18-01-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate,1st class, Muzaffarpur in connection with Baruraj P.S. Case No. 137 of 2011.
