The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Teghra P.S. Case no. 200 of 2022 instituted for the offence punishable under Sections 341, 323, 427, 379, 307/34 of the Indian Penal Code.
As per allegation in the FIR, while the informant was cooking food, several accused persons entered into her house and damaged many house hold articles. On protest made by her, petitioner no. 1 gave hansuli blow which hit her head and she fell down. Petitioner no. 2 gave iron rod blow on her head.
Patna High Court CR. MISC. No.59689 of 2022(2) dt.16-11-2022 2/3 When her family members came there to rescue her, they were also beaten up by them. It is further alleged that they have looted away a box containing gold ornaments, clothes and cash of Rs. One lac.
Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have been falsely implicated in this case. There is case and counter case between the parties. Both parties have received injuries in alleged incident. In the background of old land dispute between them, the present case has been lodged with false and concocted story. They have got no criminal antecedent.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Teghra P.S. Case no. 200 of 2022, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai
