JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This is an application for grant of anticipatory bail in connection with Ekangarsarai P.S. Case No. 177 of 2018, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 100 liters country made liquor from a house and it is alleged that the accused persons including the petitioner has fled away from the place of occurrence.

Submission of learned counsel for the petitioner is that the seizure list does not show that from which house the liquor has been recovered and four accused persons including the petitioner have named in this case and the petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Vith Additional Sessions Judge-cum-Special Judge, Excise, Nalanda at Biharsharif in connection with Ekangarsarai P.S.
