The petitioners have filed the present application under Section 482 Cr.P.C. for quashing the order dated 16.12.2011 passed by the learned 3rd Additional Sessions Judge, Ara in N.D. Case No.13 of 2011, whereby the cognizance has been taken for the offences under Sections 8(c)/20(c)/22 of the Narcotic Drugs and Psychotropic Substances Act.

Learned counsel appearing on behalf of the petitioners has very fairly conceded that during the pendency of the application the charge was framed against the accused persons including the petitioners, and now, the evidence is being recorded. In above view of the matter, the present application has become infructuous. It is, accordingly, dismissed. However, the petitioners shall be at liberty to raise all the issues, which have been raised in the present application, before the learned trial court, if the trial of the petitioners is still pending.
