2. The petitioner has preferred this application for grant of regular bail in connection with Warisaliganj P.S. Case No. 336/2025 dated 24.06.2025 registered for the offences punishable u/ss 319(2), 318(4), 338, 336(3), 340(2), 61(2), 111(4) read with Section 3(5) of the B.N.S. and Sections 66B and 66D of the I.T. Act.

3. As per the prosecution case, police got a secret information that some miscreants indulged in cyber crime are assembled near Baghi field who are cheating innocent people through mobile phone. Thereafter, police raided the said place then on seeing police 22-24 persons started fleeing away but

No.60353 of 2025(3) dt.15-11-2025 2/3 nine persons were apprehended, who disclosed their names as, Sudhanshu Patel, Vicky Kumar, Rajesh Kumar, Sudhir Kumar, Gautam Kumar, Arvind Pandit, Mantu Kumar (petitioner), Suraj Kumar and Santosh Kumar. On search, two mobile phones were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The mobile phones which were recovered from the possession of the petitioner belonged to the petitioner. The co-accused person has already been granted regular bail by this court vide order dated 25.08.2025 passed in Cr. Misc. No. 60062/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
