2. The present writ petition has been filed for the following relief(s) :

(I) To direct the Learned Circle Officer, Begusarai Sadar, Begusarai (Respondent No. 5) to pass a reasoned and speaking final order under Section 6 of the Bihar Public Land Encroachment Act, 1956, in Land Encroachment Case No 03/2023-24 (Vijay Kumar Singh vs. Prabhat Kumar Sandilya) with respect to the land pertaining to Mauza Mokimpur, Begusarai, Thana No. 348, Khata No. 36, Khesra No. 174, Rakba 1112 X 87 (approx.) which has been filed by the petitioner under Section 3 of the Bihar Public Land Encroachment Act, 1956, expeditiously

Patna High Court CWJC No.14764 of 2025(2) dt.21-11-2025 2/3 encroachment. for removing (II) To pass any other order/orders, direction/directions, relief/reliefs for which this Hon'ble Court may find this petitioner entitled as per the facts and circumstances of the present case.

3. Without going into the merits or demerits of this case, the present Writ Petition is disposed of at the stage of admission with the consent of all the counsels.

4. Learned counsel appearing on behalf of the petitioner submits that the only prayer sought for by the petitioner is passing an order under Section 6 of the Bihar Public Land Encroachment Act, 1956, in Land Encroachment Case No 03/2023-24 pending before the Respondent No. 5 herein. Counsel submits that the authority has not passed any order even though the Encroachment Case has been filed in the year 2023-24 and prays for a direction to the Respondent No. 5 to the dispose of the said Encroachment Case pending before him by fixing a time frame.

5. Having regard to the above mentioned submissions, the present Writ Petition is disposed of directing the Respondent No. 5 to dispose of the Land Encroachment Case No 03/202324 as expeditiously as possible, preferably within a period of

Patna High Court CWJC No.14764 of 2025(2) dt.21-11-2025 3/3 three months from the date of receipt of a copy of this order. It is needless to observe that before passing any orders, the petitioner and other interested party shall be put on notice and given an opportunity of hearing. Any orders passed shall be communicated to the petitioner.

6. With the above directions, the Writ Petition stands disposed of.
