The petitioners apprehend their arrest in connection with Lakhnaur P. S. Case No. 43 of 2013 (G.R. No. 740 of 2013) instituted under Sections 144, 354, 379,427,447, 504 and 506 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. The allegation, in brief, is that while the informant was making a hut in front of his house, the accused persons abused him and uprooted the hut and also cut mango tree. Learned counsel for the petitioners submits that in fact the hut was being constructed at the Vind of the pond which belongs to the petitioners, as the concerned plot of Khesra No.
Patna High Court Cr.Misc. No.6527 of 2017 (3) dt.18-03-2017 2/2 1969, Khata No. 302 over which the hut was being constructed belongs to the petitioners' side and they only objected him not to construct the hut on their land and the petitioners have no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioners, namely, Sone Lal Yadav, Shankar Yadav, Dilip yadav and Badri Yadav @ Jay Prakash Yadav, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur in connection with - Lakhnaur P.S.Case No. 43 of 2013 (G.R.No. 740 of 2013); subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
