The contention raised on behalf of the applicant is that there is no recovery from the applicant and his name has surfaced merely on the basis of extra judicial confessional statement of the main accused who has himself been granted on bail by the Court below itself.

In view of the above, the applicant is also entitled to bail.

Let the petitioner above named be enlarged on bail on his furnishing the bail-bond of Rs. 10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.318 of 2019(2) dt.17-01-2019 2/2 with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur, in connection with Sultanganj P.S. Case No. 83 of 2018.
