JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

Petitioner is in jail custody since 30.10.2018 and having more or less, similar allegation co-accused Md. Kazim has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 13.12.2016 passed in Cr. Misc.51632 of 2016. Moreover, petitioner does not have any criminal antecedent which is evident from perusal of Para-3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released

Patna High Court Cr.Misc. No.241 of 2019(2) dt.17-01-2019 2/2 on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st, Araria in connection with Jogbani P.S. Case No. 32 of 2016.
