2. The petitioner is praying for regular bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 379, 386, 504, 506, 427 of the Indian Penal Code and under Section 27 of the Arms Act.
3. The case of the prosecution is that the petitioner along with two others came into cow shed of the informant and took away his cows. It is further alleged that the accused persons were armed and fired three rounds.
4. Learned counsel for the petitioner submitted that the father of the informant has stated in his statement before police that he found the cows at some distance. It has also been submitted that the charge-sheet had already been filed. The case
Patna High Court CR. MISC. No.69659 of 2024(2) dt.07-10-2024 2/2 is triable by the Magistrate.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ara Nawada P.S. Case No.305 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur.
7. Accordingly, the present bail application stands allowed.
