JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 453C of 2015 registered under Section 420/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that the allegation is general and omnibus as no land of the complainant was sold and purchased by the petitioners. The petitioner no. 1 has purchased the land from Shiladitya Singh who is real owner of the land in question. The dispute is civil in nature. Hence no offence under Section 420 I.P.C is made out.

Patna High Court Cr.Misc. No.4210 of 2017 (2) dt.17-02-2017 Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Complaint Case No. 453C of 2015 subject to the condition as laid down under Section 438(2) of the Cr.
