04-12-2018 Heard Sri Anant Kumar Bhaskar, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner, who is named in the F.I.R., apprehending his arrest in Baniyapur P.S. Case No. 288 of 2018 registered for offence under Sections 366(A)/34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner has placed the statement of the victim recorded under Section 164 of the Cr.P.C., vide Annexure - 2 to the petition, which categorically indicates that the victim, aged about 16 years, was forcibly taken away by this petitioner alongwith others. However, learned counsel for the petitioner, by way of referring to Annexure - 3 to the petition, submits that

Patna High Court Cr.Misc. No.72138 of 2018(2) dt.04-12-2018 2/2 subsequently good sense has prevailed and a compromise petition has been filed.

On examination of statement of the victim recorded under Section 164 of the Cr.P.C., there is no reason to entertain the prayer for anticipatory bail. Further, on perusal of the Annexure - 3 to the petition, it appears that while the petitioner is at large, inference can be drawn that he is influencing the informant side.
