The petitioners apprehend their arrest in connection with Roh P.S. Case No. 79 of 2016, registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Act 2016.
Allegedly, the petitioners succeeded in fleeing way after seeing the police personnel and from the house foreign liquor in huge quantity was recovered as per seizure list and the mother of the petitioners was arrested.
Submission is of false implication and that the petitioners have got no concern with those foreign liquor, the room from where alleged recovery has been shown was open one, there
Patna High Court Cr.Misc. No.3964 of 2017 (3) dt.27-02-2017 2/2 was no door and, as such, the petitioners deserve sympathetic consideration.
The learned A.P.P. opposes the prayer of pre-arrest bail by submitting that the petitioners succeeded in fleeing away and the villagers have stated their name and further the mother of the petitioners was arrested.
In the facts and circumstances as stated above, considering the allegation against the petitioners, I am not inclined to grant privilege of pre-arrest bail to them and accordingly their such prayer stands rejected in connection with Roh P.S. Case No. 79 of 2016, pending in the Court of learned Chief Judicial Magistrate, Nawada.
