JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 10.10.2018 passed in Cr. Misc. No. 54995 of 2018 and allegation against the petitioner is of committing dacoity in the house of informant and his name has transpired on confession of co-accused and there was recovery of twenty six thousand from his house.

Submission of learned counsel for the petitioner is that he has been in judicial custody since 29.03.2018 and there is no likelihood of conclusion of trial in near future and further the name of the petitioner transpired in this case only on confession of co-accused and though it is alleged that there is recovery of Rs. Twenty Six Thousand from his house, however, the same was kept for the purpose of marriage of daughter of the petitioner and earlier while dismissing the prayer for grant of

Patna High Court CR. MISC. No.57687 of 2019(2) dt.18-09-2019 2/2 bail to the petitioner, liberty was given to him to renew his prayer for bail after framing of charge and now the charge has been framed.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Jhanjharpur, Madhubani, in connection with Rudrapur P.S. Case No. 18 of 2018, subject to the condition that one of the bailors of the petitioner should be his close relative having sufficient property within the jurisdiction of concerned court below and further petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
