JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-04-2017 Heard the learned counsel for the petitioners, the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with C.A. Case No. 794 of 2014 for the offences punishable under section 498 (A) of the I.P.C and section 4 of the Dowry Prohibition Act. Perused the Mediator's report dated 29.03.2017. Both the parties have settled their disputes amicably. The opposite party no.2 has started living with the petitioner no.1 as his first wife and the petitioner no.2 has agreed to treat the
Patna High Court Cr.Misc. No.2743 of 2017 (3) dt.03-04-2017 2/2 opposite party no.2 as his sister.
In the changed circumstances, the learned counsel for the petitioners seeks privilege of pre-arrest bail to which the learned counsel for the opposite party no.2 has got no objection. In view of the Mediator's report dated 29.03.2017, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. S.D.J.M. Katihar in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
