JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 29-07-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Sakra P.S. Case No. 242 of 2021 registered for offence punishable under sections 363 and 366(A) of the Indian Penal Code. As per allegation, co-accused Mr. Bablu Kumar enticed away the grand-daughter of the informnat. When the informant complained his family members, the family members of Bablu Kumar abused the informant.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case merely because he is uncle of main accused Bablu Kumar against whom there is an allegation of kidnapping of informant's

He has submitted further that the victim has solemnized marriage with main accused Bablu Kumar and she has sworn an affidavit in this respect, which has been annexed as Annexure-2 to this bail petition. He has also submitted that the petitioner is a person of clean antecedent.

Considering the above-mentioned facts and circumstances, specially the clean antecedent of the petitioner, let him, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIX, Muzaffarpur in connection with Sakra P.S. Case No. 242 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
