The petitioner apprehends their arrest in connection with Jandaha P.S. Case No. 175 of 2016, registered for the offences punishable under Section 420 of the Indian Penal Code and Section 7 E.C.Act.

Allegedly, 32 bags of rice weighing 17.28 quintals was found loaded on the Pick-up van Bolero bearing no. BR31GA/1505 which was being loaded from the shop of P.D.S dealer Raghubansh Prasad Singh and the petitioner is the driver of the said vehicle.

Submission is of false implication and that the petitioner was not at the spot, he has not been apprehended. He is not named, but only driver is named the petitioner was not

Patna High Court Cr.Misc. No.2758 of 2017 (2) dt.28-01-2017 2/2 knowing that the rice was going to be sold in black-marketing and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Prabhat Krishna, learned A.C.J.M.-X, Vaishali, in connection with Jandaha P.S. Case No. 175 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
