This is an application for grant of anticipatory bail for offences punishable under Section 366A of the Indian Penal Code.
It is alleged in the written report by father of the victim girl that Rajesh Kumar had kidnapped his daughter with the help of petitioners with intention to marry her. The Court's attention has been drawn to the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, copy of which is kept at page-12 to this petition, wherein the victim girl has stated that these petitioners got her seated in a car.
Patna High Court Cr.Misc. No.1807 of 2017 (2) dt.25-01-2017 2/2 She has further stated that she was taken to different places. She was forcibly taken to Mumbai. She anyhow managed to get herself free from their clutches. She has already married with Rakesh Kumar in the year 2010.
In such circumstance, prayer for anticipatory bail of the petitioners is allowed.
Let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Nawada, in connection with Narhat P.S. Case no. 117 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
