JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Roh P.S. Case no. 34 of 2016, registered under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of torturing of sister of the informant by her husband and other in-laws and also causing her death. Learned counsel for the petitioners submits that petitioners are mother-in-law and father-in-law of the deceased. Further submission is that, in fact, before the occurrence the husband of the deceased, sister of the informant, had come from his duty and before two days, deceased tried to convince her husband to take her at the place of duty, then her husband assured the deceased to take her at his duty place after finishing of duty from glacier and due to that

Patna High Court Cr.Misc. No.2397 of 2017 (2) dt.14-02-2017 2/2 reasons she committed suicide, which has come in course of investigation in paragraph No. 33, 34 and 35 of the case diary, which detailed in the order 20.12.2016 passed in ABP No. 1072 of 2016, whereby the prayer of Anticipatory Bail of the petitioners has been refused by the Court of Addl. Sessions Judge-II, Nawada. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Nawada in connection with Roh P.S. Case No.34 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
