JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 103 of 2016 arising out of Rajoun P.S. Case No. 270 of 2015 for the offenses under Sections 341, 323, 324, 307, 504, 506, 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner had earlier moved this Court in Cr. Misc. No. 53373 of 2017 and vide order dated 6.12.2017, this Court while refusing bail directed the trial court to expedite the trial and conclude the same within nine months failing which the petitioner was granted liberty to renew his prayer for bail. The aforesaid nine months has passed but the trial court has not concluded the trial.

No.77162 of 2018(2) dt.10-01-2019 2/2 Under the aforesaid circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Banka in connection with Sessions Trial No. 103 of 2016 arising out of Rajoun P.S. Case No. 270 of 2015 subject to the condition that the petitioner shall extend full co-operation in the early disposal of the trial and in the event the petitioner is found indulged in delaying the trial, the trial court may cancel his bail bonds.
