This application is for grant of anticipatory bail in connection with Runisaidpur P.S. Case No. 339 of 2009 for the offence under Sections 341, 323, 380, 354, 452, 455, 376, 511 and 504/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that he has been falsely implicated in this case and the mother of the complainant is habitual in lodging of such type of cases and so far second part is concerned that is ornamental in nature though there is allegation in the First Information Report but the same is false and concocted. Heard learned A.P.P. also. It has been submitted that there is allegation against this petitioner of attempt to commit rape. Having heard both sides. In view of the aforesaid facts, I am
Patna High Court Cr.Misc. No.4833 of 2017 (2) dt.14-02-2017 2/2 not inclined to grant anticipatory bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial. If the trial is not concluded within a period of six months, the petitioner is at liberty to move for bail.
With the aforesaid observation, this application is dismissed.
