This application for regular bail arises out of Majhauliya P.S. Case No. 248 of 2019, disclosing the offence under Section 366(A)/34 of the Indian Penal Code and Section 8 of POCSO Act.

There are seven persons named in the First Information Report including the petitioner who are said to have kidnapped the informant's minor daughter for marriage. Learned counsel appearing on behalf of the petitioner has submitted, referring to the averments made in the supplementary affidavit, that the alleged victim has since been married to co-accused Sagar Kumar who has been allowed

Patna High Court CR. MISC. No.57057 of 2019(3) dt.04-12-2019 2/2 anticipatory bail by this Court by an order dated 24.09.2019 passed in Cr. Misc. 60502 of 2019. Other similarly circumstanced co-accused persons have also been allowed anticipatory bail by this Court. The petitioner is said to be in custody since 01.06.2019.

Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge, (S.C/S.T. POCSO Act), Bettiah (West Champaran), in connection with Majhauliya P.S. Case No. 248 of 2019, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
