JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioners. The petitioners are apprehending their arrest in connection with Complaint Case No. 2254 of 2015, Trial No. 4154 of 2016, registered for the offence under Section 498(A) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. It has been submitted on behalf of the petitioners that there is general and omnibus allegation against the petitioners, who are father-in-law and mother-in-law of the informant. Heard learned A.P.P. also.
Having heard both sides and in view of the fact that the petitioners are father-in-law and mother-in-law of the informant and there is general and omnibus allegation against both the petitioners, let the petitioners, named above, in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 25,000/- each
Patna High Court Cr.Misc. No.4244 of 2017 (2) dt.09-02-2017 2/2 with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Complaint Case No. 2254 of 2015, Trial No. 4154 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the further conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioners shall co-operate in the trial and make themselves available before the court as and when required and in the event of failure on their part to appear before the court on two consecutive dates, without showing any genuine reason, their bail bonds shall be liable to be cancelled.
