JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 The petitioner apprehends his arrest in connection with Barbigha P.S.Case No. 209 of 2018 registered under Sections 409 and 420/34 of the Indian penal Code.
Allegation against the petitioner is of embezzlement of 1,60,000/- from the account of different persons and petitioner happens to be the counter clerk.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him in the FIR and moreover; he has deposited the half of the total amount as after enquiry, it was directed to deposit half amount by the Manager and the counter clerk each and petitioner is still ready to co-operate in the investigation.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.78182 of 2018(2) dt.07-01-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sheikhpura in connection with Barbigha P.S. Case No. 209 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
