JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This application, for grant of anticipatory bail, arises out of Bihar P.S. Case No. 240/18, disclosing offences under Sections 147, 148, 149, 341, 323, 326 and 307 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is that they came variously armed and made indiscriminate firing causing injury to the son and brother of the informant.
Submission of learned counsel for the petitioner is that the occurrence took place on a petty dispute of playing the cricket and further no specific allegation has been attributed to the petitioner.
Learned counsel for the State opposed the prayer for bail and submitted that there is allegation against petitioner also
Patna High Court Cr.Misc. No.78688 of 2018(2) dt.10-01-2019 2/2 of firing along with other accused persons and impugned order shows that son and brother of the informant had received gun shot injury and bullets were recovered from their chest. Having heard both sides, considering the facts and circumstances as well as the nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
