JUSTICE GOPAL PRASAD ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

This is a petition for grant of regular bail in a case under Section 392 of the Indian Penal Code.

The allegation against the petitioner and other miscreants is that they snatched Rs.1800/- from the pocket of the informant and Rs.200/- from the pocket of Raju Prasad and they also snatched A.T.M. card and key of motorcycle along with mobiles of both and thereafter fled away. However, the petitioner was apprehended in other case and thereafter the informant identified the petitioner.

Learned counsel for the petitioner submits that no Test Identification Parade has been conducted and petitioner has got criminal antecedent but it is submitted that the petitioner has been made accused in several cases on the basis of the confessional statement and the petitioner is in jail since 09.08.2012.

Hence, having regard to the facts and circumstances of the case,

Patna High Court Cr.Misc. No.49819 of 2014 (2) dt.03-03-2015 the petitioner, above named, is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bhojpur at Arrah in connection with Sandesh P. S. Case No. 80 of 2012, subject to the condition that one of the bailors shall be the near relative of the petitioner, like, the father/brother who will file affidavit to the effect that the petitioner shall not involve in such type of activity in future and further the petitioner shall file Hazari in the nearest police station once in a fortnight for one year and if any case is reported against the petitioner then the court concerned shall cancel the bail bond of the petitioner.
