JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code and Section 6(1) A of Indian Telegraph Act.

The prosecution case in nutshell is that as confessed by co-accused Anil Kumar Chaurasia in his confessional statement that he and his brother were running fake telephone exchange for which all the equipment were supplied by this petitioner. The co-accused Anil Kumar Chaurasia also stated that this petitioner used to deposit money in the account of his brother Sushil Kumar @ Sushil Kumar Chaurasia and also provided SIMs of BSNL which was fraudulently converted into international local from local calls causing financial loss to the government.

He further submits that the name of the petitioner came into light at the instance of co-accused Anil Kumar Chaurasia. He further submits that there is no material against this petitioner except confessional statement of co-accused, which is not admissible in the eye of law.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIV, Patna in connection with Gardanibagh P.S. Case No. 246 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
