1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Banmankhi Police Station Case No. 08 of 2023, disclosing offences under Sections 376 and 379 of the Indian Penal Code.

3. As per the First Information Report, the petitioner has allegedly established physical relationship with the informant on the pretext of marriage and snatched Rs. 40,000/- and some ornaments of the informant.

4. Learned Counsel for the petitioner submits that from perusal of the First Information Report, it would be evident that the informant herself is a married lady. She had

No.63805 of 2023(2) dt.18-10-2023 2/2 taken loan from Bandhan Bank of Rs. 40,000/- and taking advantage of some relationship with the petitioner, she wanted to blackmail the petitioner and demanded a sum of Rs. 40,000/- which was refused by him, accordingly, the First Information Report has been lodged.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that that the informant is a married lady, accordingly, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, Dilkhush Poddar @ Dilkhush Kumar, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Banmankhi Police Station Case No. 08 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
