2. The present writ petition has been preferred for the following relief(s):

for issuance of appropriate writ or writs, order or orders, direction or directions commanding the respondents to pay the compensation amount to the petitioners as per New Bihar State Settlement and Rehabilitation Policy 2007 in view of the acquisition of land of the petitioners, which has been acquired for construction of road under the scheme of " Mukhya MantriGramin SadakYojna'and/or for other relief or reliefs to which the petitioner may be found entitled in course of hearing of this writ application.

3. A counter affidavit has been filed by the respondent nos. 1 and 3 duly signed by the Executive Engineer, Rural Works Department, Phulparas, Madhubani according to which, no construction has been made on the land in question and

4. Learned State Counsel has taken this Court to the different Annexures of the writ petition to show that the petitioners volunteered themselves the land for better movement.

5. In this case, counter affidavit was filed in the year 2018 after service of copy to the learned counsel for the petitioner and thereafter, the order sheet shows that twice the adjournments were taken and today there is no appearance.

6. Be that as it may, since there is no appearance, dismissed for non-prosecution.
