JUSTICE ARUN KUMAR ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under Sections 302 and 34 of the Indian Penal Code.

The petitioner is an accused in a case instituted in the year 2003 under Sections 302/34 of I.P.C. and named in the F.I.R. It is alleged that all the accused including this petitioner caught hold the deceased and assaulted with deadly weapon causing his death.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was in military service and on the alleged day of occurrence, he was hospitalized and even today, he is suffering from some nerve disease and there is no specific

It appears from para-2 of this bail petition that the anticipatory bail petition of this petitioner was rejected earlier by this Court more than a decade back in the year 2006 with a direction to surrender in the court below and seek regular bail but this petitioner defied the order of court and the law and after ten years, again he is renewing his prayer for anticipatory bail without any fresh ground so for the said reason, the prayer for anticipatory bail is rejected in connection with Kurhani (Kanti) P.S. Case No.208 of 2003 pending in the court of Additional Sessions Judge-IVth, Muzaffarpur and he is directed to surrender before the court below and seek regular bail. (Arun Kumar, J) N.H./- U T
