The petitioner apprehends his arrest in connection with Baisi P.S. Case No. 200 of 2016 registered under Section 7 of E.C. Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is a P.D.S. Dealer and the seizure in this case is only 27 kg. of rice and 11 kg. wheat. The petitioner has nothing to do with the alleged offence and he has been implicated in this case due to previous enmity in village. Similarly situated co-accused persons namely Md. Balahir and Md. Akhtar @ Akhtar Raja @ Akhtar @ Akht Raza has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 4341 of 2017. Having considered the facts and circumstances of the

No.3262 of 2017 (4) dt.17-02-2017 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Purnea in connection with Baisi P.S. Case No. 200 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
