====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Mansahi P.S. Case No. 135 of 2017 registered under Sections 341, 323, 379 an 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.01.2020, charge-sheet has been submitted in the case, has antecedent of one case and the informant alleges that three miscreants came to the house of informant and took him saying that they are policemen and thereafter assaulted and looted Rs. 50,000/- and took cell phone and solar battery from the house, further it is alleged that the informant identified the petitioner. Learned counsel submits that petitioner and informant are co-villagers and are resident of the same locality and, as such it absolutely does not stand to reason

Patna High Court CR. MISC. No.72029 of 2021(2) dt.12-05-2022 2/2 that the petitioner would have committed the occurrence, thus, get identified and create evidence against himself. It is submitted that since there was a dispute between the informant and petitioner, as such the petitioner came to be implicated. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 03.01.2020, charge-sheet has been submitted in the case and is a co-villager of the informant, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mansahi P.S. Case No. 135 of 2017.
