====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 04-05-2023 Heard Mr. Devendra Kumar, learned counsel appearing on behalf of the petitioner and Mr. Lakshmi Kant Sharma, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Bairgania P.S. Case No. 193 of 2021 registered for the offence punishable under Sections 379 of 420 of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner informs this Court that due to enmity the uncle of the informant has filed the present case alleging that petitioner has withdrawn Rs.56,000/- which was deposited by his grandmother and mother. Petitioner further submits that the parties are on inimical terms since long back and a partition suit is also pending between them. He further submits that just to buy peace

4. Considering the submission made on the behalf of the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 193 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) mantreshwar/- U T
