JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 31-01-2017 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner apprehends his arrest in connection with Parwalpur P.S. Case No. 76 of 2016, registered for the offences punishable under Sections 147, 323, 307, 379, 504, 506 of the Indian Penal Code.
Allegedly, Tajuddin made an attempt to outrage the modesty of the minor daughter of the informant and the petitioner and other took away cash and ornaments.
Submission is of false implication and that the petitioner has got no criminal antecedent, he has falsely been implicated in the case and petitioner and informant are neighbours. Admittedly, land dispute between the parties is going on. The
Patna High Court Cr.Misc. No.2730 of 2017 (2) dt.31-01-2017 2/2 alleged occurrence is said to have taken place on 12.01.2016 and complaint case was filed on 18.08.2016, without any explanation for delay and, as such, the petitioner deserves sympathetic consideration as co-accused Tajuddin has been allowed pre-arrest bail and the case of the petitioner is on better footing. The learned A.P.P. submits that the petitioner is also named in the F.I.R./complaint.
In the facts and circumstances as stated above, considering that Tajuddin has been allowed pre-arrest bail passed in Cr. Misc. No. 50864 of 2016 vide order dated 29.11.2016 by another co-ordinate Bench of this court and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st-cum-Special Judge, Sitamarhi, in connection with Pupri P.S. Case No.191 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
