The petitioners seek bail in a case instituted under Sections 147, 148, 149, 341, 323, 337, 427, 353, 295 and 295A of the Indian Penal Code.
The prosecution story in brief, is that the petitioners were also the members of the mob, who indulged in violating law and order during procession.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 14.10.2016. The charge sheet has been submitted in the present case. The petitioners have got no
Patna High Court Cr.Misc. No.1081 of 2017 (2) dt.28-02-2017 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been alleged against the petitioners. No specific overt act has been alleged against the petitioners. The other coaccused have been granted bail vide Cr. Misc. No. 53432 of 2016. On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Pradip Kumar Choudhary, J.M. 1st Class, Udakishunganj, Madhepura in connection with Bihariganj P.S.
