ANJANA MISHRA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Muzaffarpur RPF Case No.239 of 2014 for allegedly having committed the offence under Section 143 of the Railway Act Learned counsel for the petitioner submits that one Aman Raj was arrested from Muzaffarpur Railway Reservation Counter and from his possession three tickets were found. It is further submitted that said Aman Raj made a confessional statement before the police indicating that in fact, the petitioner was organizing the said offence. Learned counsel for the petitioner submits that the petitioner is implicated in this case

Patna High Court Cr.Misc. No.50719 of 2014 (2) dt.21-05-2015 2/2 only on the confessional statement of said Aman Raj and there is no cogent material on the record so as to point finger at him and prove his complicity in connection with the present case. Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned court of Railway Judicial Magistrate, Sonepur, Saran at Chapra, in connection with RPF Case No.239 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
