Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Goraul P.S. Case No. 245 of 2022 lodged under Section 414 of the I.P.C. and Sections 25 (1-b) a, 26 and 35 of the Arms Act. As per the prosecution case, the recovery of country made loaded pistol have been made from the possession of the petitioner.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 12.06.2022 having five criminal cases pending against him. Learned counsel
Patna High Court CR. MISC. No.62501 of 2022(2) dt.25-02-2023 2/2 submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him. Charge sheet has already been filed in this case.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.
With this observation, the bail application stands rejected.
