This application for anticipatory bail arises out of Sare P.S. Case No. 37 of 2019 for the offence under Sections 339, 402 and 414 of the Indian Penal Code and Section 24(1b)a, 26 and 35 of the Arms Act. The petitioner has criminal antecedent, as disclosed in paragraph 3 of the application. The petitioner's name has cropped up in course of investigation.

Considering the seriousness of the offence, petitioner's criminal antecedent and the fact that custodial interrogation may be needed, I am not inclined to allow the petitioner privilege of anticipatory bail.

This application is accordingly rejected.

The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek

Patna High Court CR. MISC. No.57548 of 2019(2) dt.13-09-2019 2/2 regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
