The petitioner has preferred this application for grant of regular bail in a case registered under sections 406, 409, 420 and 34 of the Indian Penal Code.

As per the prosecution case, the allegation against the Chairman Reena Devi and the Ward Secretary Ranjan Kumar, the petitioner herein is of defalcation of a total sum of Rs. 8,97,500/- It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The Chairman Reena Devi has been enlarged on bail vide order dated 9.12.2021 passed in Cr. Misc. no. 50007 of 2021.

Patna High Court CR. MISC. No.71954 of 2021(2) dt.07-06-2022 2/2 Referring to the said order dated 9.12.2021 it is submitted that the work under the scheme has already been completed. The petitioner is in custody since 16.9.2021 and case of the petitioner who is in custody stands on a better footing to that of co-accused Reena Devi who has been enlarged on anticipatory bail. The petitioner has no criminal antecedent and investigation in the case is complete.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, grant of anticipatory bail to co-accused Reena Devi, the petitioner having remained in custody for over 8 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Goroul P.S. Case no. 124 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I Vaishali at Hajipur.
